Luxe AI Studio respects the intellectual property rights of others and expects users of our services to do the same. This Copyright Policy outlines how we handle claims of copyright infringement and our procedures under applicable law, including the Digital Millennium Copyright Act (DMCA).

1. Copyright Ownership and Content Responsibility

User-Submitted Content: By uploading photographs or any material to Luxe AI Studio, you affirm that:

  You are the copyright owner  or
  You have obtained express, written permission to use and submit the content.

AI-Generated Assets: You retain full ownership of the AI-generated content (“Assets”) created using our services, based on your uploaded photos and instructions. However, Luxe AI Studio retains a  non-exclusive license to process, store, and use submitted content and Assets for the purpose of providing, improving, and enforcing the Services, as stated in our Terms of Service.

2. Prohibited Content

You may not upload, share, or distribute any content that:

Infringes on third-party copyrights or intellectual property rights
Contains unauthorized use of likenesses, trademarks, logos, or copyrighted material
Was not created by you or that you don’t have permission to use

3. Copyright Infringement Notification (DMCA Takedown Notice)

If you are a copyright holder (or authorized representative) and believe that material hosted by Luxe AI Studio infringes your copyright, please submit a written notice including the following:

1. Your physical or electronic signature
2. Identification of the copyrighted work claimed to be infringed
3. Description of where the infringing material is located (URL or screenshot)
4. Your name, address, telephone number, and email
5. A statement that you have a good faith belief the use is unauthorized
6. A statement, under penalty of perjury, that the information is accurate and that you are the copyright owner or authorized to act on their behalf

Note: Misrepresenting claims may subject you to legal liability under Section 512(f) of the DMCA.

4. Counter-Notification Process

If you believe that your content was wrongly removed or disabled due to a mistake or misidentification, you may file a counter-notification. This must include:

1. Your physical or electronic signature
2. Identification of the material and its location before it was removed
3. A statement under penalty of perjury that you have a good faith belief the removal was in error
4. Your name, address, phone number, and consent to the jurisdiction of the courts in your location

We may restore the removed content at our discretion unless the copyright owner initiates legal action within 10–14 business days.

5. Repeat Infringers

Luxe AI Studio may, in appropriate circumstances and at its sole discretion, suspend or terminate users who are repeat infringers or submit repeated, bad-faith takedown notices or counter-notifications.
